[§ 5111.88.12] § 5111.8812. Department of MR/DD to be responsible for portion of nonfederal share of expenditures.
 

(A)  Subject to division (B) of this section and beginning not later than two and one-half years after the date the ICF/MR conversion pilot program terminates, the department of mental retardation and developmental disabilities shall be responsible for a portion of the nonfederal share of medicaid expenditures for ICF/MR services incurred for any beds of an intermediate care facility for the mentally retarded that are reconverted to providing ICF/MR services under section 5111.8811 [5111.88.11] of the Revised Code. The portion for which the department shall be responsible shall be the portion that the department and department of job and family services specify in an agreement. 

(B)  The department of mental retardation and developmental disabilities shall not be responsible for any portion of the nonfederal share of medicaid expenditures for ICF/MR services incurred for any beds of an intermediate care facility for the mentally retarded that are in excess of the number of beds the facility had while participating in the ICF/MR conversion pilot program.
