[§ 5111.87.2] § 5111.872. Allocation of enrollment numbers to county boards.
 

When the department of mental retardation and developmental disabilities allocates enrollment numbers to a county board of mental retardation and developmental disabilities for home and community-based services specified in division (B)(1) of section 5111.87 of the Revised Code and provided under any of the components of the medicaid program that the department administers under section 5111.871 [5111.87.1] of the Revised Code, the department shall consider all of the following: 

(A) The number of individuals with mental retardation or other developmental disability who are on a waiting list the county board establishes under division (C) of section 5126.042 [5126.04.2] of the Revised Code for those services and are given priority on the waiting list pursuant to division (D) or (E) of that section; 

(B) The implementation component required by division (A)(4) of section 5126.054 [5126.05.4] of the Revised Code of the county board's plan approved under section 5123.046 [5123.04.6] of the Revised Code; 

(C) Anything else the department considers necessary to enable county boards to provide those services to individuals in accordance with the priority requirements of divisions (D) and (E) of section 5126.042 [5123.04.2] of the Revised Code.

Effect of Amendments

H.B. 95, Acts 2003, effective June 26, 2003, in the introductory paragraph, inserted "specified in division (B)(1) of section 5111.87 of the Revised Code and," and "any of," and substituted "components" for "component"; inserted "or (E)" in (A); in (C), substituted "divisions" for "division,"; and inserted "and (E)."
