[§ 5111.68.6] § 5111.686. Time frames for release of amount withheld.
 

The department of job and family services shall release the actual amount withheld under division (A) of section 5111.681 [5111.68.1] of the Revised Code, less any amount the exiting operator owes the department and United States centers for medicare and medicaid services under the medicaid program, as follows: 

(A) Ninety-one days after the date the exiting operator files a properly completed cost report required by section 5111.682 [5111.68.2] of the Revised Code unless the department issues the report required by section 5111.685 [5111.68.5] of the Revised Code not later than ninety days after the date the exiting operator files the properly completed cost report; 

(B) Not later than thirty days after the exiting operator agrees to a final fiscal audit resulting from the report required by section 5111.685 [5111.68.5] of the Revised Code if the department issues the report not later than ninety days after the date the exiting operator files a properly completed cost report required by section 5111.682 [5111.68.2] of the Revised Code; 

(C) Ninety-one days after the date the department waives the cost report requirement of section 5111.682 [5111.68.2] of the Revised Code unless the department issues the report required by section 5111.685 [5111.68.5] of the Revised Code not later than ninety days after the date the department waives the cost report requirement; 

(D) Not later than thirty days after the exiting operator agrees to a final fiscal audit resulting from the report required by section 5111.685 [5111.68.5] of the Revised Code if the department issues the report not later than ninety days after the date the department waives the cost report requirement of section 5111.682 [5111.68.2] of the Revised Code.
