[§ 5111.23.5] § 5111.235. Per resident per day rate for other protected costs.
 

The department of job and family services shall pay a provider for each of the provider's eligible intermediate care facilities for the mentally retarded a per resident per day rate for other protected costs established prospectively each fiscal year for each facility. The rate for each facility shall be the facility's desk-reviewed, actual, allowable, per diem other protected costs from the calendar year preceding the fiscal year in which the rate will be paid, all adjusted for the estimated inflation rate for the eighteen-month period beginning on the first day of July of the calendar year preceding the fiscal year in which the rate will be paid and ending on the thirty-first day of December of that fiscal year. The department shall estimate inflation using the consumer price index for all urban consumers for nonprescription drugs and medical supplies, as published by the United States bureau of labor statistics. If the estimated inflation rate for the eighteen-month period is different from the actual inflation rate for that period, the difference shall be added to or subtracted from the inflation rate estimated for the following year.

Effect of Amendments

151 v H 66, effective July 1, 2005, substituted "a provider for each of the provider's eligible intermediate care facilities" for "each eligible nursing facility and intermediate care facility", and deleted "except for franchise permit fees paid under section 3721.53 of the Revised Code" following "all adjusted".
