[§ 5111.20.3] § 5111.203. Hearing on adverse determination on need for nursing facility services.
 

Regardless of whether or not an applicant for admission to a nursing facility or resident of a nursing facility is an applicant for or recipient of medical assistance, the department of job and family services shall provide notice and an opportunity for a hearing to any applicant for admission to a nursing facility or resident of a nursing facility who is adversely affected by a determination made by the department of mental health under section 5119.061 [5119.06.1] of the Revised Code or by the department of mental retardation and developmental disabilities under section 5123.021 [5123.02.1] of the Revised Code. The hearing shall be conducted in the same manner as hearings conducted under section 5101.35 of the Revised Code. Any decision made by the department of job and family services on the basis of the hearing is binding on the department of mental health and the department of mental retardation and developmental disabilities.
