[§ 5111.04.2] § 5111.042. Actions affecting services for recipient with mental retardation or developmental disability.
The departments of mental retardation and developmental disabilities and job and family services may approve, reduce, deny, or terminate a service included in the individualized service plan developed for a medicaid recipient with mental retardation or other developmental disability who is eligible for medicaid case management services. If either department approves, reduces, denies, or terminates a service, that department shall timely notify the medicaid recipient that the recipient may request a hearing under
section 5101.35 of the Revised Code.

Effect of Amendments
151 v H 66, effective July 1, 2005, deleted the second sentence, which read: "The departments shall consider the recommendations a county board of mental retardation and developmental disabilities makes under division (B)(1) of
section 5126.055 of the Revised Code."
