[§ 4905.24.2] § 4905.242. Merger when service deemed inadequate.
 

Whenever the public utilities commission finds after hearing that the service furnished by any telephone company in any portion of its territory is inadequate and that such telephone company is unable or unwilling to render adequate service, the commission may recommend that such company's facilities in that portion of its territory be integrated, merged, consolidated, or otherwise combined with one or more telephone companies furnishing telephone service in adjoining areas. Such recommendation shall set forth in detail the suggested plan of integration, merger, consolidation or other combination. 
 

In the event such integration, merger, consolidation or other combination is not effected within a time established by the commission, the commission may authorize any telephone company to provide telephone service in the area upon application and in the manner provided in section 4905.241 [4905.24.1] of the Revised Code.
