2006 Ohio Revised Code - 4723.99. Penalties.
(A) Except as provided in division (B) of this section, whoever violates section 4723.03, 4723.44, or 4723.73 of the Revised Code is guilty of a felony of the fifth degree on a first offense and a felony of the fourth degree on each subsequent offense.
(B) A registered nurse or licensed practical nurse who violates division (A) or (B) of
section 4723.03 of the Revised Code by reason of a license to practice nursing that has lapsed for failure to renew or by practicing nursing after a license has been classified as inactive is guilty of a minor misdemeanor.
