§ 4517.14. Grounds for denial of salesperson's license.
 

The registrar of motor vehicles shall deny the application of any person for a license as a salesperson and refuse to issue the license if the registrar finds that the applicant: 

(A) Has made any false statement of a material fact in the application; 

(B) Has not complied with sections 4517.01 to 4517.45 of the Revised Code; 

(C) Is of bad business repute or has habitually defaulted on financial obligations; 

(D) Has been guilty of a fraudulent act in connection with selling or otherwise dealing in motor vehicles; 

(E) Has not been designated to act as salesperson for a motor vehicle dealer or manufactured home broker licensed to do business in this state under section 4517.10 of the Revised Code, or intends to act as salesperson for more than one licensed motor vehicle dealer or manufactured home broker at the same time, except that a licensed salesperson may act as a salesperson at any licensed dealership owned or operated by the same corporation, regardless of the county in which the dealership's facility is located; 

(F) Holds a current motor vehicle dealer's or manufactured home broker's license issued under section 4517.10 of the Revised Code, and intends to act as salesperson for another licensed motor vehicle dealer or manufactured home broker; 

(G) Has, less than twelve months prior to making application, been denied a salesperson's license or had a salesperson's license revoked. 

The registrar may refuse to issue a salesperson's license to an applicant who was salesperson for, or in the employ of, a motor vehicle dealer or manufactured home broker at the time the dealer's or broker's license was revoked. The registrar's finding may be based upon any statement contained in the application or upon any facts within the registrar's knowledge, and, immediately upon refusing to issue a salesperson's license, the registrar shall enter a final order and shall certify the final order together with his findings to the motor vehicle dealers board.

Effect of Amendments

150 v H 230, effective September 16, 2004, added the exception to the end of (E).
