Publisher's Note: The following is a compilation of substances scheduled pursuant to RC §§ 3719.41 (07/01/76, 05/19/93, 07/21/94, 07/01/96, 05/17/00), 3719.43, and 3719.44. This compilation has been prepared by the Ohio State Board of Pharmacy to assist health professionals and law enforcement officers in determining: (1) whether or not a drug or drug product is a controlled substance; (2) which schedule a substance has been placed in; (3) whether or not the substance was placed in, added to, or transferred to a different schedule according to Section 3719.41, 3719.43, and/or 3719.44 of the Revised Code; and (4) the date that each substance was added to or transferred from one schedule to another. Following each substance, in parenthesis or brackets, are the dates that the substance was placed in that schedule. The date in parentheses ( ) indicates the date that a substance was placed in the schedule by the federal government. A date prior to July 1, 1976, the original enactment date of RC § 3719.41, indicates the date that the substance was controlled under federal law only (i.e. Comprehensive Drug Abuse Prevention and Control Act of 1970; 21 U.S.C. 801-966). The date in brackets [ ] indicates the date that the substance was added or transferred to the schedule by the Board pursuant to § 3719.44. Footnotes are used to provide additional information.

SCHEDULE II 

(A) Narcotics-opium and opium derivatives 

Unless specifically excepted under federal drug abuse control laws or unless listed in another schedule, any of the following substances whether produced directly or indirectly by extraction from substances of vegetable origin, independently by means of chemical synthesis, or by a combination of extraction and chemical synthesis: 

(1) Opium and opiate, and any salt, compound, derivative, or preparation of opium or opiate, excluding apomorphine (6-28-76) [4-1-78], thebaine-derived butorphanol (7-14-92), dextrorphan (10-1-76), nalbuphine (10-1-76) [4-1-78], nalmefene (11-4-85), naloxone, and naltrexone (3-6-75) [4-1-78], and their respective salts, but including the following:

SCHEDULE III 

(A) Stimulants 

Unless specifically excepted under federal drug abuse control laws or unless listed in another schedule, any material, compound, mixture, or preparation that contains any quantity of the following substances having a stimulant effect on the central nervous system, including their salts, their optical isomers, position isomers, or geometric isomers, and salts of these isomers, whenever the existence of these salts, isomers, and salts of isomers is possible within the specific chemical designation: 

(1) All stimulant compounds, mixtures, and preparations included in schedule III pursuant to the federal drug abuse control laws and regulations adopted under those laws; (6-15-73) 

(2) Benzphetamine; (6-15-73)

(B) Depressants

(1) Anabolic steroids. (2-27-91)24 Except as otherwise provided in division (E)(1) of schedule III, "anabolic steroids" means any drug or hormonal substance that is chemically and pharmacologically related to testosterone (other than estrogens, progestins, and corticosteroids) and that promotes muscle growth. "Anabolic steroids" does not include an anabolic steroid that is expressly intended for administration through implants to cattle or other nonhuman species and that has been approved by the United States secretary of health and human services for that administration, unless a person prescribes, dispenses, or distributes this type of anabolic steroid for human use. "Anabolic steroid" includes, but is not limited to, the following:

(2)(a) A product containing ephedrine shall not be considered a controlled substance if the product is a food product or dietary supplement that meets all of the following criteria: (effective 03/31/97) 

(i) It contains, per dosage unit or serving, not more than the lesser of twenty-five milligrams of ephedrine alkaloids or the maximum amount of ephedrine alkaloids provided in applicable regulations adopted by the United States food and drug administration, and no other controlled substance. 

(ii) It contains no hydrochloride or sulfate salts of ephedrine alkaloids. 

(iii) It is packaged with a prominent label securely affixed to each package that states all of the following: the amount in milligrams of ephedrine in a serving or dosage unit; the amount of the food product or dietary supplement that constitutes a serving or dosage unit; that the maximum recommended dosage of ephedrine for a healthy adult human is the lesser of one hundred milligrams in a twenty-four-hour period for not more than twelve weeks or the maximum recommended dosage or period of use provided in applicable regulations adopted by the United States food and drug administration; and that improper use of the product may be hazardous to a person's health.

(3) A drug product that contains the isomer pseudoephedrine, or any of its salts, optical isomers, or salts of optical isomers, shall not be considered a controlled substance if the drug product is labeled in a manner consistent with federal law or with the product's over-the-counter tentative final monograph or final monograph issued by the United States food and drug administration. (effective 03/31/97) 

(4) At the request of any person, the board may except any product containing ephedrine not described in division (K)(1) or (2) of this section or any class of products containing ephedrine from being included as a schedule V controlled substance if it determines that the product or class of products does not contain any other controlled substance. The board shall make the determination in accordance with this section and by rule adopted in accordance with Chapter 119. of the Revised Code. (effective 07/21/94 and 03/31/97)

"Dietary supplement": [21 USC 321(ff) of the United States Code effective 10/30/98] 

(1) means a product (other than tobacco) intended to supplement the diet that bears or contains one or more of the following dietary ingredients: (a) a vitamin; (b) a mineral; (c) an herb or other botanical; (d) an amino acid; (e) a dietary substance for use by man to supplement the diet by increasing the total dietary intake; or (f) a concentrate, metabolite, constituent, extract, or combination of any ingredient described in clause (a), (b), (c), (d), or (e); 

(2) means a product that (a) is intended for ingestion in a form described in section 350(c)(1)(B)(i) of this title; or complies with section 350(c)(1)(B)(ii) of this title; (b) is not represented for use as a conventional food or as a sole item of a meal or the diet; and (c) is labeled as a dietary supplement; and 

(3) does: 

(a) include an article that is approved as a new drug under section 355 of this title, certified as an antibiotic under section 357 of this title, or licensed as a biologic under section 262 of Title 42 and was, prior to such approval, certification, or license, marketed as a dietary supplement or as a food unless the Secretary has issued a regulation, after notice and comment, finding that the article, when used as or in a dietary supplement under the conditions of use and dosages set forth in the labeling for such dietary supplement, is unlawful under section 342(f) of this title; and 

(b) not include an article that is approved as a new drug under section 355 of this title, certified as an antibiotic under section 357 of this title, or licensed as a biologic under section 262 of Title 42, or an article authorized for investigation as a new drug, antibiotic, or biological for which substantial clinical investigations have been instituted and for which the existence of such investigations has been made public, which was not before such approval, certification, licensing, or authorization marketed as a dietary supplement or as a food unless the Secretary, in the Secretary's discretion, has issued a regulation, after notice and comment, finding that the article would be lawful under this chapter. 

"Ephedrine alkaloids" means: [Sec. 3719.44(L)(3) of the Ohio Revised Code effective 10/11/02] ephedrine, pseudoephedrine, norephedrine, norpseudoephedrine, methylephedrine, and methylpseudoephedrine.

(1) The automatic addition of various compounds, mixtures, preparations, or substances to those schedules pursuant to section 3719.43 of the Revised Code following action taken by the United States Attorney General on or after July 1, 1976, and the addition of various compounds, mixtures, preparations, or substances to those schedules on or after July 1, 1976, by the State Board of Pharmacy pursuant to section 3719.44 of the Revised Code; 

(2) The automatic transfer of various compounds, mixtures, preparations, or substances within those schedules, and the automatic removal of various compounds, mixtures, preparations, or substances from those schedules, pursuant to section 3719.43 of the Revised Code following action taken by the United States Attorney General on or after July 1, 1976; 

(3) The transfer of various compounds, mixtures, preparations, or substances within those schedules, and the removal of various compounds, mixtures, preparations, or substances from those schedules on or after July 1, 1976, by the State Board of Pharmacy pursuant to section 3719.44 of the Revised Code. 

(B) The General Assembly hereby declares that, in amending section 3719.41 of the Revised Code in Am. Sub. H.B. 62 of the 119th General Assembly, it solely intended to legislatively add anabolic steroids to controlled substances Schedule III and did not intend to affect controlled substances Schedules I to V insofar as, prior to May 21, 1991, various compounds, mixtures, preparations, or substances had been added to, transferred within, or removed from those schedules pursuant to sections 3719.43 and 3719.44 of the Revised Code. 

SECTION 9. This act is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health, and safety. The primary reason for the necessity is that the version of section 3719.41 of the Revised Code amended by Am. Sub. H.B. 62 of the 119th General Assembly and effective May 21, 1991, did not include certain compounds, mixtures, preparations, or substances that automatically had been added to controlled substances Schedules I to V pursuant to section 3719.43 of the Revised Code following action taken by the United States Attorney General on or after July 1, 1976, and did not reflect the automatic transfer of various compounds, mixtures, preparations, or substances within those schedules pursuant to section 3719.43 of the Revised Code following action taken by the United States Attorney General on or after July 1, 1976. The clarification of the status of controlled substances Schedules I to V is necessary to eliminate any uncertainty as to the nature of the controlled substances that may be the subject of offenses under Chapters 2925. and 3719. of the Revised Code. Therefore, this act shall go into immediate effect.
