[§ 339.09.2] § 339.092. County election on agreement.
 

(A)  If a resolution is adopted by the board of county commissioners under section 339.091 [339.09.1] of the Revised Code authorizing an initial agreement for the acquisition, operation, or lease of a county hospital operated by a board of county hospital trustees under section 339.06 of the Revised Code, the board shall promptly certify the question of whether the board of county commissioners, board of county hospital trustees, or county hospital commission shall be authorized to enter into the agreement to the board of elections for the purpose of having the question placed on the ballot at the next primary or general election or a special election called for this purpose. Such question shall be filed with the board of elections not later than four p.m. on the seventy-fifth day before the day of the election. The board of elections shall prepare the ballots and make other necessary arrangements for submission of the question to the electors of the county. The election shall be conducted, canvassed, and certified in the manner provided in Title XXXV [35] of the Revised Code. 

(B)  The election shall be held at the regular places for voting in the county. The board of elections shall publish a notice of election, in one or more newspapers of general circulation in the county, at least once no later than ten days prior to the election. The notice shall state all of the following: 

(1) A general description of the lands, buildings, and equipment of the county hospital that is the subject of the agreement; 

(2) The stated public purpose of the agreement; 

(3) The entities that will be signatories to the agreement; 

(4) A summary of the agreement. 

(C)  The form of the question to be presented on the ballot at the election shall be substantially: "shall the  ........... (board of county commissioners, board of county hospital trustees, or county hospital commission) be authorized to enter into  ........... (type of agreement) with  .......... (name of party to agreement) for the  .......... (acquisition, operation, or lease) of  .......... (general description of the county hospital lands, buildings, and equipment)?" 

(D)  The board of elections shall promptly certify the results of the election to the board of county commissioners. If a majority of the electors voting on the question vote in favor of the agreement, the board of county commissioners, board of county hospital trustees, or county hospital commission is authorized to enter into the agreement under section 140.03, 140.05, 339.09, or 339.14 of the Revised Code.
