[§ 3121.89.10] § 3121.8910. Civil penalties for failing to make report.
 

An employer that fails to make a new hire report shall be liable to the department of job and family services for a civil penalty of twenty-five dollars for each failure to make a report. 
 

If the failure to make a new hire report is the result of a conspiracy between the employer and the employee not to supply the report or to supply a false or incomplete report, the employer shall be liable for a civil penalty of five hundred dollars for each such failure.

The effective date is set by section 3 of H.B. 200 (150 v  - ). 

 

Effect of Amendments

150 v H 200, effective March 21, 2005, in the first paragraph, substituted "liable to" for "required by" and "for a civil penalty of" for "to pay a fee of not more than"; and, in the second paragraph, substituted "the employer shall be liable for a civil penalty of" for "the department shall require the employer to pay a fee of not more than".
