2006 Ohio Revised Code - [2947.06.1] 2947.061.[Repealed]

[§ 2947.06.1]  § 2947.061. Repealed.

Repealed, 146 v S 2, § 6 [131 v 684; 133 v H 686; 133 v H 1136; 136 v H 837; 139 v s 199; 139 v H 269; 140 v H 291; 145 v H 571; 145 v S 186; 146 v H 4]. Eff 7-1-96.

This section set regulations for probation after serving thirty days or six months of sentence,  - shock probation - , and attendance at hearing for probation.

The repeal of RC § 2947.06.1 by SB 2 (146 v  - ) is confirmed in § 2 of SB 269 (146 v  - ), effective 7-1-96. The provisions of § 12 of SB 269 (146 v  - ) read as follows:

SECTION 12. The repeal by this act of section 2947.061 of the Revised Code is intended to confirm the result intended by the General Assembly in enacting Am. Sub. S.B. 2 and Sub. H.B. 4 of the 121st General Assembly. Both acts passed on June 29, 1995. Am. Sub. S.B. 2 repealed the section while Sub. H.B. 4 amended it. The existence of the section is therefore uncertain. The intention of the General Assembly was for the section to be neither continued nor revived as the result of its amendment by Sub. H.B. 4, but rather for the section to be repealed as provided in Am. Sub. S.B. 2.
