§ 2911.32. Tampering with coin machines.
 

(A)  No person, with purpose to commit theft or to defraud, shall knowingly enter, force an entrance into, tamper with, or insert any part of an instrument into any coin machine. 

(B)  Whoever violates this section is guilty of tampering with coin machines, a misdemeanor of the first degree. If the offender previously has been convicted of a violation of this section or of any theft offense as defined in section 2913.01 of the Revised Code, tampering with coin machines is a felony of the fifth degree.

1974 Committee Comment to H 511

This section defines, with slight modification, an offense similar to a former prohibition against forcing an entry into a coin receiving device. The offense is viewed as a minor-league variety of safecracking. Because coin box tampering is frequent and increasing, however, it was considered appropriate to punish violations as serious misdemeanors on first offenses, and as felonies on subsequent violations, similar to the penalty provisions used in many theft offenses under the new code. 

Tampering with coin machines is a misdemeanor of the first degree. If the offender has previously been convicted of a theft offense, tampering with coin machines is a felony of the fourth degree.
