[§ 119.06.2] § 119.062. Cancellation or suspension of driver's license without hearing; notice of order.
 

(A)  Notwithstanding section 119.06 of the Revised Code, the registrar of motor vehicles is not required to hold any hearing in connection with an order canceling or suspending a motor vehicle driver's or commercial driver's license pursuant to section 2903.06, 2903.08, 2907.24, 2921.331 [2921.33.1], 4549.02, 4549.021 [4549.02.1], or 5743.99 or any provision of Chapter 2925., 4509., 4510., or 4511. of the Revised Code or in connection with an out-of-service order issued under Chapter 4506. of the Revised Code. 

(B)  Notwithstanding section 119.07 of the Revised Code, the registrar is not required to use registered mail, return receipt requested, in connection with an order canceling or suspending a motor vehicle driver's or commercial driver's license or a notification to a person to surrender a certificate of registration and registration plates.

The effective date is set by section 4 of S.B. 123. 

The provisions of § 5 of S.B. 123 (149 v  - ), as amended by § 3 of H.B. 163 (150 v  - ), read as follows: 

SECTION 5. (A) Notwithstanding division (B) of section 1.58 of the Revised Code, the provisions of the Revised Code amended or enacted in Sections 1 and 2 of Am. Sub. S.B. 123 of the 124th General Assembly shall apply only in relation to conduct and offenses committed on or after January 1, 2004. Conduct and offenses committed prior to January 1, 2004, shall be governed by the law in effect on the date the conduct or offense was committed. * * * 

The provisions of §§ 4, 5 of SB 62 (145 v  - ), changing the effective date of SB 275 (144 v  - ), read as follows: 

SECTION 4. That Section 3 of Sub. S.B. 275 of the 119th General Assembly be amended to read as follows: 

"Sec. 3. Sections 1 and 2 of this act shall take effect September 1, 1993." 

SECTION 5. That existing Section 3 of Sub. S.B. 275 of the 119th General Assembly is hereby repealed. 

 

Effect of Amendments

S.B. 123, Acts 2002, effective January 1, 2004, substituted "canceling" for "revoking" in (A) and (B); and substituted "2903.06 ... or 4511" for "4507.16, 4509.24, 4509.291, 4509.31, 4509.33, 4509.37, 4509.39, 4509.42, 4509.66, 4511.191, or 4511.196" in (A).
