Article 17 - Adulteration, Packing, and Branding of Food and Food Products
204-B - Foods Containing Fats And/or Oils.

§ 204-b. Foods containing fats and/or oils. 1. (a) Notwithstanding any
other provision of law, each individual fat and/or oil ingredient of a
food commodity in package form intended for human consumption shall be
declared by its specific common or usual name in its order of
predominance in the food except that blends of fats and/or oils may be
designated as such in their order of predominance as "vegetable",
"animal", "marine" shortening, or combination of these, whichever is
applicable if, immediately following the term, the common or usual name
of each individual vegetable, animal, or marine fat or oil is given in
parenthesis.

(b) For products that are blends of fats and/or oils and for foods in which fats and/or oils constitute the predominant ingredient, the listing of the common or usual names of such fats and/or oils in parenthesis shall be in descending order of predominance.

(c) In all other foods in which a blend of fats and oils is used as an ingredient, the listing of the common or usual names in parenthesis need not be in descending order of predominance if the manufacturer, because of the use of varying mixtures, is unable to adhere to a constant pattern of fats and/or oils in the product.

(d) Fat and/or oil ingredients not present in the product may be listed if they may sometimes be used in the product if such ingredients are identified by appropriate language or words indicating that such ingredients may not be present. 2. For the purposes of this section the term "food commodity in package form" shall be construed to mean a food commodity put up or packaged in any manner in advance of sale in units suitable for retail sale, which has been packaged at point of manufacture and which is not intended for consumption at point of manufacture and which is presently not exempt from placing the ingredients on the label.
