2006 New York Code - Powers Of Municipal Corporations.



 
    §  834-b.  Powers of municipal corporations. Any county, city, town or
  village within the territorial limits of the district, by  ordinance  or
  resolution  of  its  governing  body,  shall  have  the following powers
  hereinafter enumerated which shall not be  deemed  to  have  any  effect
  upon,  or  to modify, any other powers of any such county, city, town or
  village, and which shall not be deemed  to  have  any  effect  upon,  or
  modify,  any  of the other provisions of this title. Each such ordinance
  or resolution shall constitute a covenant with the authority which shall
  enure to the benefit of the holders  of  any  bonds  issued  under  this
  title,  and  which  shall  be a part of the contract with the holders of
  such bonds. Such ordinance or resolution may:
    1. Provide for the establishing,  locating,  constructing,  equipping,
  maintaining  and operating of market facilities by the authority in such
  county, city, town or village, and for such purposes, or  any  of  them,
  such county, city, town or village may:
    (a)  Sell  any  of  its  property,  real or personal, or any interests
  therein, or grant licenses affecting the same to  the  authority  for  a
  nominal  consideration or otherwise and upon such other terms, covenants
  and conditions, if any, as may be agreed upon between the authority  and
  such county, city, town or village.
    (b)  Lease  any  of  its  property, real or personal, or any interests
  therein to the authority for a nominal consideration  or  otherwise  and
  upon  such  other  terms,  covenants  and  conditions, if any, as may be
  agreed upon between  the  authority  and  such  county,  city,  town  or
  village,  for  a  period  of  not to exceed fifty years and an option to
  renew for a period of not to exceed fifty years as may  be  agreed  upon
  between the authority and such county, city, town or village.
    (c)  Provide  municipal  services,  facilities  or  utilities  to  the
  authority for the benefit of the market facilities owned or operated  by
  the authority in such county, city, town or village.
    2.  For  the purposes of protection of public health, the facilitation
  of inspection of fruits, vegetables, live poultry and poultry  products,
  the  enforcement  of sanitary regulations and the general welfare of the
  community, prescribe in such county, city,  town  or  village  an  area,
  including  and  adjoining the market facilities owned or operated by the
  authority, wherein the buying and the  selling  of  fruits,  vegetables,
  live  poultry  and  poultry products at wholesale may be confined to the
  market facilities owned or operated by the authority  within  such  area
  and  the dealing in such commodities within such area outside the market
  facilities  owned  or  operated  by  the  authority  may  be   otherwise
  regulated,  restricted or controlled. Such area shall be of such size as
  the county, city, town or village shall determine to  be  necessary  for
  the accomplishment of such purposes.
