§ 5-354 Acquisition of real estate. In all cases where the commissioner shall hereafter enter upon, acquire, take or use, or shall deem it necessary to enter upon, acquire, take or use, any real estate, for the purpose of maintaining, preserving or increasing the supply of pure and wholesome water for the use of the city, or for the purpose of preventing the contamination or pollution of the same, the commissioner is authorized in behalf, and in the name of the city of New York, pursuant to the provisions of this subchapter, and pursuant to the provisions of the eminent domain procedure law, to acquire all rights, titles and interests in and to such real estate, by whomsoever the same may be held, enjoyed or claimed, and to pay for and extinguish all claims or damages on account of such rights, titles or interests, or growing out of such taking or using.
