2006 New York Code - Garages In Buildings Having Dwelling Occupancies; Requirement.



 
    §   27-4074   Garages   in   buildings  having  dwelling  occupancies;
  requirement.  The ground floor area of a garage in a  building  occupied
  as  a  dwelling  must  not exceed five thousand square feet, and no more
  than two stories above the garage shall be occupied or  used  as  living
  apartments,  which apartments shall be separated from the garage by fire
  retarding walls and floors, not pierced except by one opening, protected
  by a fireproof self-closing door, and there shall be an entrance to  the
  living  apartments  direct  from  the street without passing through the
  garage. In case  the  building  is  of  non-fireproof  construction  and
  occupied  by  two  families  and on two stories above the garage, a fire
  escape or other secondary means of escape  must  be  provided  for  each
  story  above  the garage. No certificate of fitness shall be required of
  the person having supervision of  such  garage  unless  the  same  be  a
  storage  garage  containing  more  than four vehicles. The provisions of
  this section shall not apply to a dwelling which is occupied by not more
  than two families and under or adjacent to which there is a  garage  for
  not  more  than  two pleasure cars owned by the occupant or occupants of
  the dwelling.
