2006 New York Code - Notification Of Discharges Affecting Groundwaters.
§ 17-0826. Notification of discharges affecting groundwaters. Whenever a provision of this title is violated by a facility operating under or pursuant to a SPDES permit and located within an area designated pursuant to any federal or state statute as a sole source aquifer, all public water purveyors with a service area or portion thereof located within a three mile radius of the violating facility shall be notified by the department of such violation if the department determines that the violation could have a significant impact on the water resources of the area. The department's notices pursuant to this section shall be made within fourteen days of the official notice of noncompliance of the SPDES permit to the violating facility. For the purposes of this section "public water purveyor" shall mean any person, partnership, public or private corporation, municipality, or public authority which sells water derived from a sole source aquifer to at least five service connections or at least twenty-five individuals.
