§ 13-0321. Taking and importation of shellfish for transplanting and other purposes. 1. Shellfish may be taken from uncertified shellfish lands for transplanting or other purposes as the department may deem advisable subject to supervision and regulation as provided in section 13-0319. 2. Prior to the taking from uncertified shellfish lands of this state for transplanting or other purposes, a permit shall be obtained from the department and shall be issued for the taking of shellfish from a specific area. Such permit shall be valid only during the period of operations in the uncertified land for which the permit was issued. The holder of such permit may not receive, sell, offer for sale, transport, or ship any shellfish taken pursuant to this permit, except as provided by regulations made pursuant to section 13-0319. 3. Shellfish from certified or uncertified lands without the state shall not be transplanted in this state or imported into this state for such purposes unless a permit therefor has been obtained from the department.
