    §  391-a. Notwithstanding any inconsistent provisions of this article,
  or of any other general, special or local  law,  a  county  tuberculosis
  hospital  may  also  admit  for  study  and  care  persons  with chronic
  nontuberculous diseases of the chest, subject to rules  and  regulations
  to  be  promulgated  by the state commissioner of health with the advice
  and counsel of an advisory committee consisting of  five  members  after
  consultation   with  the  boards  of  managers  of  county  tuberculosis
  hospitals; provided, however, that any person so admitted or the  person
  or  agency  who or which accepts responsibility for payment for the care
  and treatment of such person shall be charged such amount  as  fixed  by
  the board of managers of the hospital but at a rate not in excess of the
  daily cost per patient of operation of the hospital as determined by the
  state  commissioner  of  health.  Three  of the members of such advisory
  committee shall be superintendents of county tuberculosis  hospitals  to
  be  chosen by such commissioner, and two of the members thereof shall be
  representatives of the medical society of the state of New  York  to  be
  designated by such society.
