2006 New York Code - Return Of Inmates To Other Institutions.



 
    §  442.  Return  of  inmates  to  other  institutions.  If, before the
  expiration of the term  for  which  an  inmate,  received  from  another
  institution,  was  sentenced,  it  be  found  that his confinement in an
  institution  for  the  retarded  in  the  department  of  correction  is
  unsuitable,  for any reason, and the commissioner of correction shall so
  certify in writing to the officer in  charge  of  the  institution  from
  which  such person was received, such person shall be forthwith returned
  to the institution from which he came,  by  the  superintendent  of  the
  institution for the retarded; provided, however, that if he was received
  from  a correctional facility he shall be transferred to and received by
  such correctional facility as the commissioner shall  direct.  Upon  any
  such  return  or transfer all credits earned against the sentence of the
  inmate in the institution for the retarded shall be deemed to have  been
  earned in the institution to which he is returned or transferred.
