2006 New York Code - Stop-use, Stop-removal And Removal Orders.


 
    § 185. Stop-use,  stop-removal  and removal orders. 1. Any weights and
  measures official  shall  have  the  power  to  issue  stop-use  orders,
  stop-removal   orders  and  removal  orders  with  respect  to  weights,
  measures, and weighing and  measuring  devices  and  systems,  being  or
  susceptible of being commercially used, and to issue stop-removal orders
  and  removal  orders  with respect to packages or amounts of commodities
  kept, offered or exposed for  sale,  sold  or  in  process  of  delivery
  whenever  in  the  course  of  his enforcement of the provisions of this
  article he deems it necessary or expedient to issue such orders.
    2. It shall be unlawful for any person to use, or remove  or  fail  to
  remove from the premises specified, as appropriate, any weight, measure,
  weighing  or  measuring  device  or  system, package, commodity or other
  thing, contrary to the terms of any order issued under the authority  of
  this section.
    3. A "stop-use order", when used in this section, shall mean any order
  or written notice declaring that the device, system or other thing being
  used  is  in contravention of this article and such use shall be stopped
  or discontinued.
    4. A "stop-removal order", when used in this section, shall  mean  any
  order  or written notice declaring that the device, system, commodity or
  other thing being used or handled is in contravention  of  this  article
  and  shall  be  removed from use or sale for a reasonable period of time
  pending correction.
    5. A "removal order", when used in this section, shall mean any  order
  or  written  notice  declaring that the device, system, commodity or any
  other thing being used or handled is in contravention  of  this  article
  and shall be permanently removed from use or sale.
