Section 59A-32-1 - Assigned risk plan, short title.

Sections 520 through 532 [59A-32-1, 59A-32-3 to 59A-32-13 NMSA 1978] of this article comprise and may be cited as the "Motor Vehicle Assigned Risks Law".

ANNOTATIONS

Constitutionality of rate rollback legislation. — Legislature can constitutionally require insurers to roll back premium rates if the roll back does not result in the establishment of confiscatory rates or if there is a statutory mechanism to allow insurers to obtain rate relief in the event that confiscatory rates result. 1991 Op.
