Section 70-5-10 - Revenue; suspense fund.

70-5-10. Revenue; suspense fund.

All fees and money collected under the provisions of the LPG and CNG Act [this article] shall be remitted by the bureau to the director of the division to be deposited in the general fund of the state. The bureau may maintain a "special suspense fund" with the division in an amount of one thousand dollars ($1,000) budgeted by the bureau for the purpose of making any necessary refunds. The bureau shall, with the advice and consent of the director of the division, employ inspectors, assistants and other necessary help as may be required to carry out its lawful duties.

ANNOTATIONS

The 1993 amendment, effective July 1, 1993, deleted "LP gas" preceding "Revenue" in the section heading; in the first sentence, substituted "money" for "moneys", inserted "and CNG", and deleted "forthwith" following "remitted"; and deleted "and" preceding "inspectors" in the third sentence.

Refund of fee denied. — A license fee paid by a company that was illegally operating in the state without a license prior to the time fee was paid should not be refunded when licensee chooses not to operate in the state. 1961-62 Op. Att'y Gen. No. 61-101.
