3-46-29. Finding of necessity by local governing body.
No municipality shall exercise any of the powers conferred upon municipalities by the Urban Renewal Law [ 3-46-1 to 3-46-45 NMSA 1978] until after its local governing body shall have adopted a resolution finding that:
A. one or more slum, blighted, or land development areas exist in the municipality; and
B. the rehabilitation, conservation, development or redevelopment or a combination thereof, of such area or areas is necessary in the interest of the public health, safety, morals or welfare of the residents of the municipality.
