3-46-24. Land development project.

As used in the Urban Renewal Law [ 3-46-1 to 3-46-45 NMSA 1978], "land development project" includes undertakings or activities of a municipality in any land development area to eliminate the conditions which caused the area to be designated as a land development area and shall include:   

A.     acquisition of real property within the land development area;   

B.     clearing the land and grading, replatting in accordance with the land development plan, installation, construction or reconstruction of roads, streets, curbs, gutters, sidewalks, storm drainage facilities, water lines or water supply installations, sewer lines and sewage disposal installations, steam, gas and electric lines and installations, airport facilities, and construction of any other needed public facilities or buildings whether on or off the site if deemed necessary by the local governing body in order to prepare the land in the land development area for residential, commercial, industrial, and public use in accordance with the land development plan;   

C.     making the land available for development by private enterprise or public agencies, including sale, initial leasing or retention by the municipality itself, at its fair value for uses in accordance with the land development plan.
