Section 153-A:10-a - Criminal History Record Checks For Provider Licensure and Relicensure.

    153-A:10-a Criminal History Record Checks For Provider Licensure and Relicensure. –
I. Every applicant for initial licensure, reinstatement after license action from the division, or license renewal after lapsing, shall complete a criminal history records check prior to such licensure, reinstatement, or renewal conducted through department of safety records and through the Federal Bureau of Investigation. Upon completion of the records check, the department of safety shall release copies of the criminal history records to the division.
II. If, after 2 attempts, a set of fingerprints is invalid due to insufficient pattern, the division may, in lieu of the criminal history records check, accept a statewide criminal history records background check from the appropriate state identification bureau, or equivalent, from every state where the person has lived or worked during the past 10 years.
III. The division shall maintain the confidentiality of all criminal history records information received pursuant to this section. The applicant shall bear the cost of a criminal history record check.
IV. An applicant for licensure under RSA 153-A:11 who is currently employed as a certified law enforcement officer in this state in a position which requires a criminal history records check, shall not be subject to the requirement in paragraph I for completion of a criminal history records check prior to initial or renewal of licensure.
