Chapter 137-J - Written Directives for Medical Decision Making for Adults Without Capacity to Make Health Care Decisions
Section 137-J:34 - Applicability.

137-J:34 Applicability. –
The surrogacy provisions of this chapter shall not apply to instances in which the patient has a valid and unrevoked living will, or an authorized agent under a durable power of attorney for health care and the patient's condition falls within the coverage of such advance directives, as defined in this chapter. In those instances, the living will or durable power of attorney for health care shall be given effect according to its terms.
