Section 408:10 - Incontestability.

NH Rev Stat § 408:10 (2015) What's This?

    408:10 Incontestability. – The policy shall be incontestable after it shall have been in force during the lifetime of the insured for 2 years from its date, except (a) for non-payment of premiums, (b) for violations of the policy relating to naval or military service in time of war, and (c) at the option of the company, for provisions granting or increasing benefits in the event of total and permanent disability and provisions which grant additional insurance specifically against death by accident; provided, however, that this section shall not apply to a policy issued by a life insurance corporation organized under the laws of this state if such policy is issued on the life of a person who is neither a resident nor a citizen of the United States of America, if such policy is delivered to the policyholder outside the continental limits of the United States of America and its territories, and if the laws and regulations of the nation in which the policy is delivered to the policyholder do not prohibit the delivery of a life insurance policy which contains no incontestability clause, so-called.
