260:70 Continuance of Action; Costs. – The court in which the action is pending may order such continuances as may be necessary to afford the defendant reasonable opportunity to defend the action. The fee of $2 paid to the director by the plaintiff at the time of the service shall be taxed in his costs if he prevails in his suit.
