Section 71-3,168
Investigations; review; recommendation; prosecution.

(1) The board shall review the results of each investigation brought before it by the department and shall make a recommendation as to whether the evidence presented appears to substantiate the existence of a violation.

(2) When the department, upon the recommendation of the board, finds that there is probable cause to suspect a violation has occurred based on the results of an investigation, it shall forward all pertinent material along with a statement of its findings to the Attorney General. The Attorney General shall review the material submitted, taking the recommendation of the board under advisement, and shall advise the board and the department promptly of his or her findings. If the Attorney General determines that a probable violation has occurred, he or she shall begin proceedings to obtain an injunction against the party or parties involved if such a step is deemed necessary or to take other disciplinary action against a licensee.
