Section 37-461
Muskrats; permit to destroy; violation; penalty.

If any dam, canal, drainage ditch, irrigation ditch, private fish pond, aquaculture facility, artificial waterway, railroad embankment, or other property is being damaged or destroyed by muskrats, the commission may issue a permit to the owner or owners of such dam, canal, ditch, pond, facility, waterway, embankment, or other property to take or destroy such muskrats, and the commission may make and enforce rules in connection with the issuance of such permits as are necessary to prevent the illegal destruction of muskrats by any holder of such a permit. Any person violating this section shall be guilty of a Class III misdemeanor and shall be fined at least fifty dollars.
