Improper delivery--penalty.

411.641. A warehouseman who delivers grain out of his possession, knowing that a negotiable receipt, the negotiation of which would transfer the right to the possession of that grain, is outstanding and uncanceled, without obtaining possession of the receipt at or before the time of the delivery, is guilty of a felony, and upon conviction shall be punished for each offense by imprisonment by the department of corrections and human resources for not less than two nor more than five years.
