§ 99-25-17. Search warrant and capias

Universal Citation: MS Code § 99-25-17 (2017)

"The State of Mississippi.

"To any lawful officer of ____ County:

    • "Oath having been made before the undersigned, a justice of the peace of

      said county, that a box of candles and a case of brogan shoes, the property of

      Edward Nolly, on or about the ____ day of ____ 1906, in said county, were

      feloniously taken, stolen, and carried away and that suspicion rests on Samuel

      Miller as guilty of said crime, and affiant has reason to believe and does

      believe that the said stolen articles, or some of them, are concealed in or

      about the dwelling house, or outhouses connected therewith, of the said Samuel

      Miller, in said county:

      "We command you, with the necessary assistance, to enter into the said

      dwelling house of Samuel Miller, and the outhouses connected therewith, and

      there diligently search for the said goods and chattels; and if the same, or

      any part thereof, be found, that you bring them, and also the body of said

      Samuel Miller, forthwith before the undersigned, or some other justice of the

      peace, to be disposed of according to law.

      "Witness my hand, the ____ day of ____ , 1906.

      "Andrew Sims, J.P."

A search warrant may be only to search for stolen goods, and omit the command to arrest the person.
