Chapter 37 - Replevin
§ 11-37-111. Form of the writ

Universal Citation: MS Code § 11-37-111 (2017)

The writ of replevin shall be in the following form, to-wit:

"State of Mississippi

County of ____

To the sheriff of any lawful officer of ____ County:

We command you to immediately seize and take into your possession (here

describe the property as shown in the declaration) alleged by ____, the

plaintiff, to be wrongfully detained by ____, the defendant, and to deliver

said property to the plaintiff unless bonded by the defendant; and to summon

the said defendant to appear before the ____ court of ____ County,

Mississippi, at ____ o'clock ____.M., on the ____ day of ____, 2____, to

answer the suit of the plaintiff for the wrongful detention of said property,

and have then and there this writ.

WITNESS MY HAND, this ____ day of ____, 2____.
