§ 11-23-29. Form of a claimant's bond

Universal Citation: MS Code § 11-23-29 (2017)

A claimant's bond may be in the following form, viz.:

"We, ____ , principal, and ____ and ____ , sureties, bind ourselves to pay

____ dollars, unless the said ____ shall prosecute with effect his claim to a

____ [here describe the property], levied on by virtue of an execution issued

on the ____ day of ____ , A.D. ____ , by ____ court of ____ county, in favor

of ____ against ____ , returnable before the ____ court on the ____ day of

____ , A.D. ____ , and valued at ____ dollars: or, in case he fail therein,

shall pay to the said ____ all such damages as may be awarded against the said

____ , in case his claim shall not be sustained, and shall deliver the same

property to the officer having said execution, if the claim thereto shall be

determined against the said ____ .

"Witness our hands, this ____ day of ____ , A. D. ____ .

"I approve the foregoing bond and sureties, this the ____ day of ____ ,
