2006 Massachusetts Code - Chapter 94 — Section 65G. Definitions.

Section 65G. For the purposes of sections sixty-five G to sixty-five U, inclusive, the following words and phrases shall have the following meanings:—

“Department”, the department of public health.

“Frozen desserts”, ice cream, French ice cream, frozen custard, ice milk, sherbet, water ice, quiescently frozen confection, quiescently frozen dairy confection, frozen dietary dairy dessert and any imitation frozen dessert.

“Frozen dessert mix”, any unfrozen mixture to be used in the manufacture of frozen desserts or milk shakes.

“Imitation frozen dessert”, any frozen substance, mixture or compound, regardless of the name under which it is sold or exchanged, or offered or exposed for sale or exchange, or advertised, which is made in imitation or semblance of any frozen dessert, or is prepared or frozen in the manner in which any frozen dessert is customarily prepared or frozen, and which is not ice cream, French ice cream, frozen custard, ice milk, sherbet, water ice, quiescently frozen confection or quiescently frozen dairy confection as manufactured in accordance with the regulations promulgated by the department under section sixty-five U.
