2006 Massachusetts Code - Chapter 30 — Section 39E. Inducing rebates or refunds or transportation charges; penalties.

Section 39E. Whoever, by force or the use of threats, intimidation or coercion of any kind, induces any common carrier or contract carrier or the person who has furnished or provided transportation on any contract for which a payment bond is required under section thirty-nine A to make a rebate or refund of any transportation charges or to give up any part of any payment to which he is legally entitled or to render an incorrect bill for less than the established minimum rates and charges prescribed by the department of telecommunications and energy shall be punished for a first offense by a fine of one thousand dollars, for a second offense by a fine of fifteen hundred dollars and for any subsequent offense by a fine of two thousand dollars.
