2006 Massachusetts Code - Chapter 138 — Section 53. Forfeiture and disposition of implements and furniture.

Section 53. All implements of sale and furniture seized under sections forty-two and forty-five shall be forfeited and disposed of in the manner provided for the forfeiture and disposition of alcoholic beverages; but the court may, if it is deemed to be for the interest of the commonwealth, order the destruction or sale of said property by any officer qualified to serve criminal process and the proceeds of a sale thereof shall be paid over to the county; and said officer shall make return of the order for such destruction or sale and his doings thereon to the court issuing the same. The provisions of this section shall not apply to a motor vehicle if seized and held to be an implement of sale as aforesaid, but the disposition of such a motor vehicle shall be governed by the provisions of section fifty.
