Title 18.5. Peer-to-Peer Car Sharing Programs.
§ 18.5-104. Odometer fraud prohibited.

  • (a) Charges may not be based on distance traveled. -- If the peer-to-peer car sharing program knows that the vehicle's odometer does not record correctly its actual accumulated mileage, a peer-to-peer car sharing program may not, with intent to defraud, enter into a peer-to-peer car sharing program agreement with a shared vehicle driver for which any charge is based on the distance traveled.

  • (b) Deception regarding distance traveled prohibited. -- A peer-to-peer car sharing program may not otherwise enter into a peer-to-peer car sharing program agreement with a shared vehicle driver for which any charge is based on the distance traveled and deceive that shared vehicle driver as to the distance that the shared motor vehicle traveled during the car sharing period.

  • (c) Penalties. -- A person convicted of a violation of this section is subject to imprisonment not exceeding 6 months or a fine not exceeding $ 500 or both.
