§ 6-1103. Removal; exemption

  • (a) Removal from products designed for use by consumers and manufactured after December 31, 1993. -- Unless granted an exemption by the Department, rechargeable batteries contained in products designed for use by consumers and manufactured after December 31, 1993 shall be easily removed.

  • (b) Exemption. -- Upon application, the Department may exempt from the requirements of this section a rechargeable battery contained in a product designed for use by consumers upon a finding that:

    • (1) For reasons such as health or safety cannot be redesigned; and

    • (2) The product is covered by a unit management program.
