§ 27-915. Coverage for organ transplantation -- Individual with disability

  • (a) "Organ transplantation" defined. -- In this section, "organ transplantation" means the transplantation or transfusion of a human body part into the body of another individual for the purpose of treating or curing a medical condition.
  • (b) Applicability. -- This section applies to:
    • (1) insurers and nonprofit health service plans that provide coverage for organ transplantation to individuals or groups on an expense-incurred basis under health insurance policies or contracts that are issued or delivered in the State; and
    • (2) health maintenance organizations that provide coverage for organ transplantation to individuals or groups under contracts that are issued or delivered in the State.
  • (c) Coverage not denied on basis of disability. -- An entity subject to this section may not deny coverage for an organ transplantation solely on the basis of an insured's or enrollee's disability.
  • (d) Coverage not required where transplantation not medically necessary. -- This section may not be construed to require an entity subject to this section to provide coverage for an organ transplantation that is not medically necessary.
