§ 27-608.1. Transfer of policyholder between insurers

  • (a) Applicability of section. -- This section applies to policies of commercial insurance and policies of workers' compensation insurance.
  • (b) Notice. --
    • (1) If a policyholder is being transferred between admitted insurers within the same insurance holding company system, as defined in ยง 7-101 of this article, the insurer providing the new policy shall provide notice of the transfer to the policyholder.
    • (2) An insurer shall be considered to have met the notice requirement of this section if the insurer has sent to the named insured a renewal policy that includes a notice of transfer, or a notice on the declaration page of the renewal policy, notifying the insured that the policy has been transferred from the prior named insurer to the new or renewing named insurer.
