§ 6-852. Spot checks of properties reported or verified as satisfying the modified risk reduction standards

  • (a) Authority of Department. -- The Department may, at any time, spot check affected properties that have been reported as satisfying the risk reduction standard or verified as satisfying the modified risk reduction standard.
  • (b) Failure to satisfy standards -- Reported properties. -- If a spot check pursuant to subsection (a) of this section reveals that an affected property that has been reported as satisfying the risk reduction standard under § 6-815 of this subtitle does not satisfy that standard, the Department may order that the owner of the property satisfy the risk reduction standard, as verified by an inspection conducted within 30 days of receipt of the order.
  • (c) Failure to satisfy standards -- Verified properties. -- If a spot check pursuant to subsection (a) of this section reveals that an affected property that has been verified as satisfying the modified risk reduction standard under § 6-819 of this subtitle, but has not been reported as satisfying the risk reduction standard under § 6-815 of this subtitle, does not satisfy the modified risk reduction standard, the Department may order the owner of the property to satisfy the modified risk reduction standard, as verified by an inspection conducted within 30 days of receipt of the order.
