Subtitle 16 - Bad Faith Assertions of Patent Infringement.
§ 11-1605. Civil actions.

  • (a) In general. -- In addition to any action by the Division or Attorney General authorized by Title 13 of this article, a target may bring an action in an appropriate court to recover for injury or loss sustained as a result of a violation of this subtitle.
  • (b) Awards. -- If a target prevails in an action brought under this subtitle and is awarded damages, the court also may award:
    • (1) Court costs and fees, including reasonable attorney's fees;
    • (2) Exemplary damages in an amount not to exceed the greater of:
      • (i) $ 50,000; or
      • (ii) Three times the total of damages, costs, and fees; and
    • (3) Any equitable relief that the court considers appropriate.
