§ 12-6C-11 - Violations; penalties.


MD Health Occ Code § 12-6C-11 (2013) What's This?

(a) Fine. --

(1) If a person knowingly violates any provision of this subtitle or any regulation adopted under this subtitle, the Board may impose a fine not to exceed $ 500,000.

(2) Before the Board imposes a fine, the Board shall consider the appropriateness of the fine in relation to:

(i) The size of the wholesale distributor;

(ii) The gravity of the violation for which the fine is to be imposed;

(iii) The good faith of the wholesale distributor; and

(iv) Any previous violations by the wholesale distributor.

(b) Disciplinary action. -- In addition to the penalty provided in subsection (a) of this section, the Board also may take disciplinary action against a permit holder who is convicted of or pleads guilty or nolo contendere to a violation of State, federal, or local drug laws.
