§ 5-511 - Immunity -- Officials of governmental entities
§5-511.
(a) (1) In this section, the following words have the meanings indicated.
(2) “Governmental entity” has the meaning stated in Article 26, § 1 of the Code.
(3) “Official of a governmental entity” has the meaning stated in Article 26, § 1 of the Code.
(b) Subject to subsection (c) of this section, an official of a governmental entity, while acting in a discretionary capacity, without malice, and within the scope of the official’s authority is immune as an official or individual from civil liability for any act or omission.
(c) An official of a governmental entity is not immune from liability for negligence or any other tort arising from the operation of a motor vehicle except as to any claim for damages in excess of the limits of any applicable policy of motor vehicle liability insurance.
