§ 5-609 - Cemetery in violation of subtitle [Effective until July 1, 2013]

§5-609.

(a) A person may not establish or operate a public or private cemetery or allow a public or private cemetery to be operated in violation of this subtitle.

(b) A person who violates this section is guilty of a misdemeanor and, on conviction, is subject to a fine not exceeding $1,000 or imprisonment not exceeding 1 year or both.

(c) If a sole proprietor registered cemeterian, a permit holder, or any other person subject to the trust requirements of this subtitle violates this subtitle, that person is guilty of a misdemeanor and, on conviction, is subject to a fine not exceeding $1,000 or imprisonment not exceeding 1 year or both.

§ 5-609 - Operation of cemetery in violation of subtitle prohibited [Effective July 1, 2013].

Except as provided in § 5-602 of this subtitle, a sole proprietor registered cemeterian, permit holder, or any other person subject to the permit or registration requirements of this title may not establish, operate, or allow a cemetery to be operated in violation of this subtitle.
